However, international law is still predicated on the basic rule of national sovereignty. Given this discrepancy, humankind is called upon to establish a system of international governance that is able to deal effectively with all the challenges that threaten its survival as a civilized community of nations. Practice is already evolving in that direction.

"Professor Peter Schlosser examines to which degree the concept of co-operation among judicial authorities has found its way into political and everyday practices. He first looks at cross-border co-operation regarding litigation in commercial and other matters involving economic interest (passive co-operation and active co-operation among judicial authorities). Professor Schlosser does this by way of a comparative approach. The author then examines the judicial co-operation in special fields, such as transborder insolvency or family matters. Here, too, the author follows a comparative approach. In his final chapter, Professor Schlosser analyses the situation of judicial co-operation in terms of various degrees of intensification and terms of special approaches (central authorities, transborder judicial co-operation, and international litigation committee, etc.)"--Publisher's description.

The book explores the current role of nationality from the point of view of international law, reassessing the validity of the 'classical', state-centered, approach to nationality in light of the 'new' role the human being is gradually acquiring within the international legal order. In this framework, the collection assesses the impact of international human rights rules on the international discourse on nationality and explores the significance international (including private international) law attaches to the links individuals may establish with states other than that of nationality. The book weighs the significance of the bond of nationality in the context of regional integration systems, and explores the fields of international law in which nationality still plays a pivotal role, such as diplomatic protection and dispute settlement in international investment law. The collection includes contributions from legal scholars of different nationalities and academic backgrounds, and offers an excellent resource for academics, practitioners and students undertaking advanced studies in international law.

The Evolution of Sustainable Development in International Law: Inception, Meaning and Status

In a remarkably short time "sustainable development" has become firmly established in international law. The World Commission on Environment and Development concisely defined this concept as: "development that meets the needs of the present generation without compromising the ability of future generations to meet their own needs". This definition combines inter-generational equity with an awareness of the finite capacity of the earth and its natural resources. This book brings together a collection of lectures given at the Hague Academy of International Law. The aim of the book is threefold: firstly, to review the genesis, clarify the meaning and assess the status of sustainable development within international law; secondly, to examine the legal principles that have emerged in the pursuit of sustainable development; and finally, to assess to what extent the current state of law demonstrates a balance between and integration of all relevant fields of international law as urged by the Rio, Johannesburg and World Summit documents.

"In his course, Theodor Meron, President of the International Tribunal for the Former Yugoslavia, sets out to study the influence of human rights on general international law. Although human rights are central to this course, this is not a course about human rights, but rather about the reforming effect that human rights have on other fields of public international law. By examining most of the general areas of public international law, the author attempts to demonstrate that the influence of human rights is not restricted to one single sector of international law, but that its influence has spread to many other parts, in varying degrees. The humanization of public international law under the impact of human rights has shifted its focus from being State-centred to individual-centred. The author proceeds to study the impact of human rights on public international law in seven chapters. He successively focuses on the humanization of the law of war, the criminalization of violations of international humanitarian law, the law of treaties, the humanization of state responsibility, subjects of international law, sources of international law, and international institutions"--Publisher's description.

The Concept of Unity in Public International Law

'Fragmentation' has become a defining, albeit controversial, metaphor of international law scholarship in the era of globalisation. Some scholars see it as a new development, others as history repeating itself; some approach it as a technical issue and some as the reflection of deeper political struggles. But there is near-consensus about the fact that the established vision of international law as a unitary whole is under threat. At the core of the fragmentation debate lies the concept of unity, but this is hardly ever rationalised and is more assumed than explained. Its meaning remains vague and intuitive. 'The Concept of Unity in Public International Law' attempts to dispel that vagueness by exploring the various possible meanings of the concept of unity in international law. However, eschewing one grand theory of unity, it identifies and compares five candidates. Intentionally pluralistic in its outlook, the book does not engage in normative arguments about whether international law is or should be unitary but seeks to show instead that the concept of unity is contested and that discourses on fragmentation are necessarily contingent. The thesis on which the book is based won the 2009 Prize for best doctoral thesis from the Association des professeurs de droit du Québec.

"David È́ric, Professor at the Free University of Brussels, proposes a detailed study of the main characteristics of the International Criminal Court. He examines successively the submission of the ICC to the consent of the States Parties (its creation, its jurisdiction, cooperation between the Court and the States, exceptions to the hold of the States on the Court, the ICC's jurisdiction rationae personæ and rationae materiae.) Professor David then observes that the ICC is a system that is both similar and different from the international criminal tribunals (institutional organization, investigation and trial of the case, issuing arrest warrants, trial in absentia, execution of sentences.) Finally, Professor David examines the co-operation between the Court and the States.
