The Internet brings opportunity and peril for media freedom and freedom of expression. It enables new forms of publication and extends the reach of traditional publishers, but its power increases the potential damage of harmful speech and invites state regulation and censorship as well as manipulation by private and commercial interests. In jurisdictions around the world, courts, lawmakers and regulators grapple with these contradictions and challenges in different ways with different goals in mind. The media law reforms they are adopting or considering contain crucial lessons for those forming their own responses or who seek to understand how technology is driving such rapid change in how information and opinion are distributed or restricted. In this book, many of the world's leading authorities examine the emerging landscape of reform in nations with variable political and legal contexts. They analyse developments particularly through the prisms of defamation and media regulation, but also explore the impact of technology on privacy law and national security. Whether as jurists, lawmakers, legal practitioners or scholars, they are at the front lines of a story of epic change in how and why the Internet is changing the nature and raising the stakes of 21st century communication and expression.

There has been intense interest in the proposals to implement Article 23, both in Hong Kong and abroad. This book will be valuable to anyone who has followed or participated in that debate or has an interest in the delicate balance between civil liberties and national security. The book will be particularly useful for legislators, policy-makers, lawyers, journalists, historians, teachers, and students, especially in the fields of law and the social sciences. The statutory Appendix will assist teachers and students to draw comparisons between existing law and the government's proposals. In 2003 more than 500,000 people marched in Hong Kong against the National Security (Legislative Provisions) Bill, which would have prohibited treason, sedition, secession, and subversion against the national government of China and included new mechanisms for proscribing political organisations. This edited collection analyses that legislation, particularly the implications for civil liberties and the one country two systems model. Although the massive protest compelled the Hong Kong government to withdraw the Bill from the legislature in 2003, it will likely propose similar legislation in the future because Hong Kong has a constitutional obligation to implement Article 23 of the Basic Law. The book provides detailed and balanced commentary on the Bill, explains why certain proposals proved so controversial, and offers concrete recommendations on how to improve the proposals before the next legislative exercise.

This book is based on the findings of a research on the jury system in HK. The issues addressed include the comprehension of HK jury, its representativeness, and the political significance of its existence (especially in the light of 1997). The research itself is unique in that judiciaries around the world tend to maintain a wall of secrecy around the operations of the jury. Suitable for law and criminology courses.

Routledge Handbook of Sexuality Studies in East Asia

This collection brings together cutting-edge work by established and emerging scholars focusing on key societies in the East Asian region: China, Taiwan, Hong Kong, Japan, North and South Korea, Mongolia and Vietnam. This scope enables the collection to reflect on the nature of the transformations in constructions of sexuality in highly developed, developing and emerging societies and economies. Both Japan and China have established traditions of ‘sexuality’ studies reflecting longstanding indigenous understandings of sex as well as more recent developments which interface with Euro-American medical and psychological understandings. Authors reflect upon the complex colonial and economic interactions and cultural flows which have affected the East Asian region over the last two centuries. They trace local flows of ideas instead of defaulting to Euro-American paradigms for sexuality studies. Through looking at regional and global exchanges of ideas about sexuality, this volume adds considerably to our understanding of the East Asian region and contributes to wider discussions of social transformation, modernisation and globalisation. It will be essential reading in undergraduate and graduate programs in sexuality studies, gender studies, women’s studies and masculinity studies, as well as in anthropology, sociology, history, cultural studies, area studies and health sciences.
