Currently, there are nearly 200 publicly traded real estate investment trusts (more commonly referred to as REITs) in operation in the United Sates with a combined $500 billion in assets. An estimated two-thirds of REITS are traded on national stock exchanges. A REIT is a real estate company that offers its shares to the public. By doing so, a REIT stock becomes like any other stock that represents the holder s ownership in a business. However, REITs have two distinct features: REITs manage groups of income-producing properties and must distribute 90 percent of profits as dividends. The Complete Guide to Investing in REITs will teach you everything you need to know about REITs and how you can earn high rates of return. In this book, you will learn about publicly and privately held REITs, Net Asset Value (NAV), Adjusted Funds From Operations (AFFO), Cash Available for Distribution (CAD), the benefits associated with REITS, dividend reinvestment programs (DRiPs), capitalization rate, equitization, leverage, positive spread investing, securitization, and straight-lining. You will also learn about equity, mortgage, and hybrid REITs and the more specific types, including residential, office, industrial, and retail. The Complete Guide to Investing in REITs will walk you through finding the appropriate REIT for you. This book will also teach you how to manage your REIT, how to limit your personal risk, how to understand REIT performance, and how to analyze REITs. By reading this book, you will know and understand the pitfalls of investing in REITs, you will know how REITs behave as an investment class and how to best integrate them into your portfolio, and you will know what economic issues affect real estate and the effects these have on REITs. This book is not merely for the novice investor who wants to learn everything possible about real estate investment trusts; professional investors, financial planners, and investment advisors will also find valuable information in this book. Ultimately, The Complete Guide to Investing in REITs will help you stabilize and grow your portfolio and earn high rates of return by providing you with vital information and practical guidance. The trust protector is generally regarded as a relatively new position in trust law, and the key feature of the position is that the protector may be granted powers over the trust, which are generally superior to those of the trustee. This places the protector in a position where, by the exercise of his powers, he can cause the trust to adjust to unforeseen changes or new conditions without the need for court action or beneficiary approval. This work takes the firm position that, with only limited exception, the role of the protector is a fiduciary one, imposing on the protector a duty to act in the best interests of the purposes of the trust and the beneficiaries. Unfortunately, a substantial segment of the legal community, as well as the legislative bodies of a number of international jurisdictions, have taken a position that the protector is not a fiduciary, or that he may be declared in the trust not to be a fiduciary, and that the power granted him under the trust may be declared to be personal powers, whether or not such is the case, and thus he would have no liability for his actions or inactions while serving as protector. This “attraction” of providing total exculpation of the protector has effectively engendered a quick acceptance of the position by the bulk of the legal community and even by the legislatures of a number of jurisdictions, though almost totally unsupported by relevant case law. As a result, we have been seeing trusts which incorporate the use of a protector having the power to make critical dispositive and administrative decisions, as well as extensive modifications to the trusts without being exposed to liability for negligence or bad decisions which result in damages. This work will examine in detail the role of the protector of the trust, the relationship between the protector and the trustee, between the protector and the beneficiaries, and the protector’s responsibilities to the purposes of the trust. It will demonstrate with legal support that the role of the protector is not a new role, that, in fact, the protector is simply a new name for the decades-old position of trust “advisor,” and that the trust advisor is consistently regarded as a fiduciary in relevant treatises and has been repeatedly held to be a fiduciary in relevant cases. The discussion will also review and analyze the historical issues and professional commentary relevant to trust law and the role of protector, as well as case decisions in various international jurisdictions which have shed light on the issues and some of the positions taken in the statutes of a number of jurisdictions in the United States and across the world. All legal aspects of the role will be examined, including the rights of the protector, the protector’s relationship to the trustee, and the courts’ regard for and treatment of the position. Further, the work will discuss in detail all of the practical considerations in using a protector, such as selection and special drafting considerations, the use of a protector in a foundation, and, in brief, the numerous tax issues that may apply. The conclusion will be that with only very limited exception, which will be explained, the protector is unquestionably a fiduciary, and just as a trustee, he should be held to fiduciary standards. Accordingly, while it is certainly possible to grant personal powers to an individual under a trust, those powers per se conflict with the duties of a protector. And while it is also possible to reduce the fiduciary liability of a protector to a minimum, it is not possible to eliminate it entirely, regardless of trust language attempting to do so.

The Thin Book of® Trust is a small book about a very important subject. A lot has been written about trust: about what it is and what it can do for people, families, companies, communities and countries. Often, good work is being sabotaged by interpersonal conflict, political infighting, paralysis, stagnation, apathy, or cynicism. Almost always, one can trace these problems to a breakdown in trust. It not only kills good work, it also inevitably creates some degree of misery, annoyance, fear, anger, frustration, resentment, and resignation. By contrast, in successful companies where people are innovative, engage in productive conflict and debate about ideas, and have fun working together, one can find strong trusting relationships. Having the trust of those you work with is too important not to be intentional about building and maintaining it. The goal of The Thin Book of® Trust is to give you enough clear and concrete language to understand and address issues of trust at work and includes some sample scripts. You will learn how to build and maintain strong trusting relationships with others, and repair trust when it is broken, by being intentional and consistent in your language and actions. Understanding and consistently demonstrating trustworthy language and behavior will help you earn and keep the trust of the people you work with. The author, Charles Feltman, is a coach with many years of experience working with all kinds of people and organizations. For this reason, he's able to define trust in a way that I hope you will find eminently useful. First he defines trust as choosing to risk making something you value vulnerable to another person's actions. He then breaks the concept of trust down into 4 assessments. That means that instead of labeling someone as untrustworthy, you can dig deeper and define which of the 4 assessments you are struggling with. The 4 assessments are: SincerityReliabilityCompetenceCareThis book includes a pull-out card with the 4 distinctions of Trust. You'll find it very useful in stimulating a conversation about Trust. If your training budget doesn't allow for a purchase of the Trust book for everyone, give everyone this card instead

The care that a patient receives in the first hours after surgery is crucial to minimizing the risk of complications such as heart attacks, pneumonia, and blood clots. As the patient awakes from their drug-induced coma, it takes time for them to metabolize and excrete these drugs, during which period they remain unable to care for themselves, and at increased risk of harm. The recovery room staff must manage both comatose and physiologically unstable patients, and deal with the immediate post-operative care of surgical patients. The fifth edition of this popular book provides nurses, surgeons and anaesthetists with clear guidance on how to manage day-to-day problems and how to make difficult decisions. Previous editions of this book have established it as the definitive guide to setting-up, equipping, staffing, and administering an acute care unit. It includes basic science such as physiology and pharmacology, specific symptoms including pain and vomiting, and has chapters devoted to the unique post-operative needs of individual types of surgery. This new edition brings this important text up to date and new drugs and techniques for monitoring are described. A new section looks ahead to the future development and design of recovery rooms and how they can contribute to patient well being.
